But what court would rule in favor of the team? You think that patron would buy tickets in that section if they knew 90+ mph foul balls are going to come hurling at them periodically, and they may are may not be protected depending on how loose the net is?
The net maker, the installer, the park itself.. A case could and probably will be made.

actually.. her ticket says she takes on any and all liability when she enters the stadium and agrees not to sue for injury. Its not basically every ticket to every stadium. Most parks will pay something but if the fan gets too pushy/threatening they will take it all the way.

That's what you get for turning your back to the action at a live sporting event.
