10 USC 111(a) The Department of Defense is an executive department of the United States.

10 USC 113(a) There is a Secretary of Defense, who is the head of the Department of Defense.

Even your hero understands this to be the case, because he quietly dictated that "Department of War" was to be a SECONDARY designation, all while requiring his administration to USE that secondary designation.

Here is Dear Leader's proclamation. In relevant part, it says the following:
