That was the argument the government made and was rejected by SCOTUS. They focused on how tracking a cell phone can be tracked even on private property and how no one seems to be able to not have one attached. They also mentioned that very few people know their phones do this and even fewer no that their carrier keeps it.

BTW your cell phone sends a signal to a cell site every 2 minutes. It does so whether your phone is in a public area or in a private residence. The location of every tower you ping is recorded by your carrier. It is called CSLI and can be obtained with a search warrant.

Also for you folks who use Google Location History, that gives your precise location (not just tower) and is also kept by Google. It can be obtained with a search warrant.

Red Eagle - the Short version of that is "SCOTUS has not ruled that viewing a vehicle passing by on a public road is a search. Further SCOTUS has treated automobiles very differently. A warrant less search of a vehicle can be conducted when a search warrant is required to search a house.

In Carpenter v U.S. SCOTUS held that tracking a phone for 127 days required Police to obtain a search warrant (very much like the requirement to get a court order to install a GPS tracker). It did not hold that a data base containing that info can not be created.

However my point stands. All the other data bases I cited can be used to create a similar profile of someone's movements and actions. Requiring a warrant is far different than demanding the technology be banned. So what are people demanding Flock tech be banned but not the other?
