Saw two entertainment industry lawyers discussing it. They agreed that in 48 states no. But Cali and NY passed laws to protect radical lefties that will unintentionally make this interesting and should at least go to trial....

My understanding is they make sense if you can charge at home overnight and drive around town and don't have to worry with paying to recharge.

Bus driver for minor league sports teams. Hockey, baseball, and Arena Football.
Attended upwards of 150 pro sports events in dozens of cities. NBA arenas down to barely larger than little league baseball fields....

Am I mistaken or is white elehant and gag gifts totally different things?
I understood a white elephant to be a gift of an actual white elephant which can't be used for work in certain religions but is expensive to keep....
