I understand but I feel you are missing the point as well as the author by ignoring very plausible reasons that they were handled differently.

His main arguments are:The time it took to the trial, and the amount of coverage. One was handled by the court(which set a date) and the other by the FA(which set a much sooner date). Suarez talked and LFC wore shirts creating stories. Terry STFU so what was there to write about since October? Nothing. The media did hammer Terry in October. There has been nothing new to the story, so what did he want them to write about?

ETA:Also in England they have very strict laws about writing or commenting about legal cases. So since Terry's is in court, I don't think they can call him a racist until convicted. The author of that article doesn't mention that. The only reason I know about it is because the English soccer shows I listen to will not comment on anything and have given that as a reason.

It was well known that KK and Suarez had a huge language barrier. How were they supposed to know that they needed to educate someone else on how not to bring in certain aspects of their culture? Hell, the entire country is too stupid to even realize that. They discard the culture aspect of it, oh so very conveniently, with no explanation as to why it doesn't apply.

If it was as much a part of Suarez "culture", I'm sure he had said it before. Someone should have picked up on it. If it wasn't said before, he was lying about how "culturally accepted" it is in Uruguay. Fair?

Fair, and I'll be shocked if he's convicted that the media doesn't hammer him. It really could cost him his career.

Or maybe the rest of the world isn't as much of a huge pussy about it as Evra is. I think thats the more likely scenario.

Its a fact. There were multiple sociology professors and cultural anthropologists that stated that it is a normal part of South American culture.

I know what the "experts" said and am not disputing it. What I am disputing is that he had to have said it before and it should have been dealt with at that time. That is all that I am saying. For instance, Baseball players have south americans and I have never seen a major leaguer be "misunderstood" by saying negro. I'm sure it is handled well before hitting the majors.

This is a judicial tribunal. The first thing they tell you in law school is never make assumptions. They shouldn't be making them here, and by doing so they're making a mockery of justice.

I have no idea what a judicial tribunal is, so I can't comment on that. What I'm saying is it couldn't be both ways. He has been out of Uruguay for some time. So can you believe that this was the first incident of him using this word out of Uruguay?

It just means some type of administrative authority given power to hear a dispute.

Personally I think he's used it before. Seems that way. My opinion doesn't matter though. That's why we have a judicial system. There was no evidence presented to the FA proving he had, and therefore establishing his ill intent when he used to at Evra. Evidence is required for liability. There was none here (in regard to his intent).

Have you read the entire FA release on the Suarez incident? I haven't, I know it was basically Evra said this....but I thought Suarez admitted to saying it based on his "cultural" defense. Wouldn't that be considered evidence? Then they just went all letter of the law on him.

I meant evidence in regard to his intent to say it with malice, verifying him as a racist.

Not in my opinion. Because what your saying isn't racist (no matter what it is) if you didn't mean it with hate. In my opinion you can't be negligently racist. You either hate someone or you don't. You can't accidentally hate someone. Apparently the FA doesn't agree with me.

Let me clarify. I'm speaking for the point of the person saying the racist remark. So what I'm saying is, Luis is not a racist if he says something that someone construes as being racist. It's an intent thing, not a negligence thing.

Basically, you can't say something racist and not be a racist because the intent of what you originally said (whether its racist or not) is determined by your mindset, not the other way around.

Ok Jesus that was confusing. I guess I'm having trouble finding the words for what I'm trying to say.

EDIT: In a nutshell I guess what I'm saying is, it starts with what's in your brain, and flows from that. If you say something everyone else "thinks" is racist, but you never meant it to be, then you shouldn't be punished for it. At least in this situation.

I see what you are saying.
I, however, think that both suarez and terry said something racist and definitely meant it that way and should be punished. I don't necessarily think that they are racist though. I'm sure they both have black friends (johnson, malinda, easier, ashley cole (more yellow) etc.) They just were pissed and reacted in the heat of the moment in a way they shouldnt have.

doesn't make it ok, just makes them count, not necessarily racists.
