Not just the mandate that district court ruled against, this is the entire thing. Holy shite.
The Department of Justice has determined that the district court's comprehensive opinion came to the correct conclusion and will support it on appeal," said Kerri Kupec, spokesperson for the Justice Department.
It's a major shift for the Justice Department from when Jeff Sessions was attorney general. At the time, the administration argued that the community rating rule and the guaranteed issue requirement -- protections for people with pre-existing conditions -- could not be defended but the rest of the law could stand.
After the Justice Department took that position, federal District Judge Reed O'Connor struck down the entire law and the case is currently before a federal appeals court.

GOOD! We need to go back to where things were pre obama and obamacare. That shite stain on America needs to be wiped clean off of the face of the earth.
There weren’t 50 gazillion people dying in the streets before obamacare and there won’t be after it’s dismantled. Liberals and their brainwashed sheep are so f’n weak minded and stupid!
ETA: where are you seeing this? Not doubting you but I’d like to see for myself. Do you have a link?

You got to fix your thread title.
The 5th Circuit hasn't ruled anything. The DOJ just isn't going to argue for the law being upheld.

Reading through it. He had already ruled against Obamacare back in December.
But he stayed that decision so as not to wreck the system overnight but this article doesn't make clear what the judge did tonight.
I'll see it in the morning
However, the "5th Circuit" hasn't ruled on it though. Just the district court back in December.
ETA: the more I read this and other articles that I can find right now the more it sounds like the article is incomplete or misleading. Not your fault.
