U.S. attorneys do not serve district court judges. They serve presidents.

It is a huge separation of powers issue and SCOTUS will have to address it. Meanwhile, the DOJ does have a 6 month window, per statute, to address Jimbo Comey. Big Jim thought he was off the hook.
