I agree with you and I would add two more reasons I'm taking a 'wait and see' attitude on this pick:
1. He was hired by Elena Kagan to be a professor at Harvard. We all know who Elena Kagan is, right?!?!
2. Catholic with a Jesuit background. Jesuits are the social justice order in the church.
I would have loved to see a non-Ivies, non-establishment person, and I will wait to see just how much of a constitutionalist he truly is.
