Remember late last week Abbott went on a tweet thread calling out the administration and FDA for giving no opportunity to reopen their plant despite no link of bacteria in any product or production area

Yep, be a thorn in their side and file suit for political retribution to stop the inquiry. The purpose would be to run out the clock on the Democrats powers.
