So is this Jury equivalent to the Jews that let the murderer go free in place of Jesus?

You wouldn't care about this if it didn't involve an illegal. FACT.

You also have no idea what the particulars of the case were and what was presented that may have constituted reasonable doubt. FACT.

I'm never going to cheer an innocent party dying, but you all don't give a frick about the dead girl past how far you can politicize her death. Also FACT.

Sorry, Jbird.

Aren’t you a law student?

Give me more on the mens rea element of murder in California. Even a report from someone inside the courtroom would be helpful.

From the outside looking in, it looks like the State overcharged without being able to prove intent.

Here are some other facts:

That jury found him guilty of being a felon in possession of a firearm. That all agreed he had the gun. And he confessed to shooting it.

They were also allowed to choose between murder 1 and involuntary manslaughter.

Somehow that jury all agreed that an illegal immigrant who fired a gun into a crowded pier and killed someone was not guilty of involuntary manslaughter.

ETA:

I just looked it up and California (no surprise here) has some bizarrely fricked up laws.

quote:

Homicide during the commission of a felony often results in a murder charge rather than a manslaughter charge. When a killing occurred during the commission of a crime that is not a felony, the prosecutor must prove that the defendant had a criminal intent to commit the underlying unlawful act. If the defendant did not intend to engage in the crime that resulted in homicide, the state may be unable to prove involuntary manslaughter. The defendant may be able to establish a lack of intent by showing a reasonable mistake or lack of knowledge.

It looks like, as I said in another thread, the prosecutor fricked this case up. And he should he shot in the back and left to bleed to death.
