Government, police and people in general respond to incentives. Create an incentive to a police bureaucracy to pad their budget with legalized theft and this is what you get. It is easy for it to become a racket in its own right.

She Got Her Car Back More Than 6 Years After Police Seized It

quote:

After police in Berkshire County, Massachusetts, took her car, Malinda Harris did not get a chance to contest the seizure for five and a half years. After the Phoenix-based Goldwater Institute threatened to file a lawsuit on her behalf last March, the county agreed within a week to return the car, which she finally got back this summer.

quote:

The Institute for Justice estimates that "hiring an attorney to fight a relatively simple state forfeiture case costs at least $3,000 -- more than double the national median currency forfeiture." Unlike criminal defendants, owners of seized property generally have no right to court-appointed counsel, so people of modest means are ill-equipped to defend themselves against state-sanctioned theft.

Civil asset forfeiture in the US is extremely fricked up and highly abused.

It's a question of how much justice you can afford.

$3000 dollars and how much was the car worth 6 years ago and what is it worth today? There is a lot of lawyer stuff that is beyond the means of many. And yes, this business with abusive police seizures has been going on for at least 30 years, IIRC, and nothing has been done about it.

I believe she would have a legitimate claim for massive depreciation. Not to mention getting everything working again at the shop.

These official racketeers could just as easily use that as an excuse to seize her house too. However, that would immediately trigger a court fight so they probably specialize in stealing things where the cost of a lawyer exceeds the value of the theft.
