That would mean that Kennedy would basically agree that he should be replaced by a Dem president. He either retires Now or he is on the bench until 2020.

It is so absolutely stupid that it takes a blockbuster SCOTUS opinion to decide that non union members shouldn't be forced to pay for union activities. It's the most common sense thing in the world.

That wouldnt be the same situation. 2020 will have an encumbent president running. Obama was leaving office regardless in 2016 (term limit). Not the same situation.

Harry Reid the master politician made it so 40 votes against in the senate don't matter either

The House has nothing to do with it - DEMs would have to take the Senate to do what you suggest.

Because outside of the protections of the EPC, states are free to enact discrimination statutes as they see fit.
