Simply counting executive orders does next to nothing to study to what effect they've been used, how many agencies they are targeted towards, or anything about the content thereof. Executive order usage has been declining for years due to a number of trends, like the fact that in FDR's day presidents routinely used these directives for simple personnel matters that are now handled elsewhere, but the way in which the orders have been used has evolved as well.

I think the claim that Obama's use of these orders is unprecedented is over the top, but nothing about the article linked in the OP refutes any of those particular criticisms people have made. The absolute number of executive orders would be an extremely poor way to measure presidential power because, as is often the case, numbers on their own can be misleading.

Obamacare was crammed down the throats of the U. S. citizenry by 1 party vote, now the president is unilaterally making changes that clearly help out Democrats in the upcoming elections (as other posters have stated), so do all of these EOs fall under this "gray area"?

And if a Republican is elected president, what could he do to the law that would fall under this "gray area" definition? Suspend the mandate indefinitely? Not letting able bodied people, who refuse to work participate? Allowing doctors to not participate and not to have to report to the Feds? And on and on...?

Did he not ignore his responsibility to maintain the border and enforce ALL laws on the books, or did he pick and choose which ones to enforce, including laws he himself signed into law?
