I would not vote to convict in this situation. He has a right to protect his property from a foreign invader who has admitted to criminal conduct.

The article is titled “Judge declares mistrial” but not once do they talk about why there was a mistrial. Absolutely trash journalism.

Also:
quote:

Ramirez testified that they were being smuggled into the United States and were not trafficking drugs. Ramirez admitted to smuggling marijuana on one previous occasion

Yeah, we smuggled drugs before, but we promise we weren’t this time!

Edit: from a different article:
quote:

“Based upon the jury’s inability to reach a verdict on any count,” Superior Court Judge Thomas Fink said, “This case is in mistrial.”

This is big. You have a lot of Jurys that will compromise on charges. But the fact that they couldn’t reach a verdict on anything he was charged with means that there were people actually dug in and were not changing.

Did they poll the jury?]
I don't see how you could declare a mistrial without doing so.

My guess (and it IS just a guess) is that the judge asked that the headcount not be reported, in order to avoid tainting the jury pool for any possible re-trial. Of course, if that were the case, one would expect that fact to be reported, at a minimum.

The other possibility is that the reporters are just too incompetent to have understood the importance of polling the jury. I do not discount that possibility, either.

And not to mention that they couldn’t find the bullet that killed this guy. How do they know it was Kelly’s AR that killed him? How do they know it wasn’t a hunter?
