How does Merchan hand down a sentence when he never stated what crime has been committed?

Trump was charged with falsifying business records in the first degree.

The part of the statute that enhances the crime from a misdemeanor to a felony doesn't require the person who committed the initial crime to have committed the subsequent crime that enhances the crime from a misdemeanor to a felony. The prosecutor can also prove that the falsification of business records was done to aid or conceal the commission of another crime.

Note, the statute says nothing about there being a requirement that the person being charged with falsifying records has to have actually committed the subsequent crime (in this case the FEC violations, for which Cohen has already pled guilty and served time in prison).

The theory of the case is that business records were falsified, and that the underlying falsification of those business records was done with either an intent to (1) commit another crime or (2) aid or conceal the commission thereof. Bragg's theory of the case relies on Trump aiding or concealing the commission of Cohen's crimes.

None of the jurors will be able to withstand the pressure that is sure to come. Even if one or more of them has doubts about his guilt, they know that they will be identified and their, and their family's, lives will be hell.

If a guilty verdict is returned, on what grounds will an appeal be made? How does that appeal process work in New York? How fast does it work?

I suspect it will all be magically resolved and dropped immediately after the Election in November.

Not joking. The whole thing will disappear like a fart in a hurricane after the widespread fraud once again fraudulently installs Biden or his replacement.

It provides Trump with the “proof” that the deep state and democrats are out to get him and that he is the outsider victim. That’s the very core of his campaigning. If he is not convicted, then there is fairness in the system and only a few bad apples out there picking on him. If he is convicted in New York on this charge, he can beat that drum relentlessly until the election. It will add a measure of truth to his claims of victim hood.

Congratulations.

You're exactly who they look for when using propaganda to provide a means to an end.

You're very fortunate that breathing is an involuntary action.

I do too. If it’s a hung jury, Bragg will retry Trump and tie him up in court for another 6-7 weeks.

Before I was confident but after the Judge out lied what the low threshold of being guilt being if you just feel he’s guilty you don’t need evidence and you just think Trump is bad. I see fully guilty that’s not even mentioning the behind the scenes of the pressure for jurors.

Using that same theory, I want Hillary charged for falsifying business records to pay for dossier.

The dossier was paid for and used to influence the election.

The payment was hidden under “legal service”, same as Trump!

Doing so, she was hiding “another crime”!

It’s past statute of limitations, but that isn’t problem now.

Never in doubt it was going to be guilty

It is a blatantly stacked case and courtroom with only one purpose.

The DNC paid for a result they will get it in NYC

The fix has been in even before the trial started. I will be totally surprised if they let him off…

Add to that the jury is concerned for their own well being…that they will be stoned by their own kind somewhere in New York City if they find him not guilty.

except it gives the insufferable twats the ability to call him a convicted felon at every opportunity. It will just make them a little more unbearable for the next six months.

I hope there are no riots... they will make hay if there are

The jury will find him guilty.

The media and Democrats will never say the name Trump without “Convicted Felon” preceding.

The case will be overturned on appeal in 2026.

How many jurors have to vote guilty? Majority or does it got to be 100%.
