It doesn’t pass the smell test because the VAR is not the reason. They had to threaten the DOJ that they would go to Sessions if they didn’t go along with that reason. Given that, the DOJ agreed; however, Commerce said the DOJ was the one asking for the question to be included but the evidence showed that Commerce strong armed them into it. If the DOJ genuinely said they needed it for the VAR, then the court said it would have been fine.

The Roberts opinion is actually infuriating. The entire thing talks about how the reason offered is reasonable and was well-researched. It says there is nothing odd about policymakers having preconceived beliefs and then finding a legal way to implement that belief and nothing was particularly untoward about how Ross went about the citizenship question. Then in the final paragraph or two Roberts says oh, but we think he is lying about the VRA, even though he has evidence for using this justification, so it's remanded.

Well counting illegals impacts US Citizens. It's not just used for headcount. It determines house seats, funding, etc.
