Why would they be looking at runway 1 for a plane preparing for takeoff when ATC told them the plane was landing at runway 33?

Even if ATC knew the Blackhawk was 100 feet too high, it is irrelevant because they did not instruct the Blackhawk to fly under the CRJ. ATC told them to keep visual separation and go behind the CRJ.

ATC is trying to guide multiple aircraft landing and taking off. They can tell an aircraft the altitude they should be at but they can't monitor every aircraft to make sure they are at the correct altitude. The pilot has to make sure they are maintaining the correct altitude. Not sure how you are putting that on ATC.
