Possibly. But if the owner was not a LLC, I don’t think I’d be having this issue. They shouldn’t assume an LLC means the owner is a dealer or builder. My friend owns a construction company and has boats, jet skis, trucks, a frickin bus under the LLC. Makes sense to me to do so.

Follow-up:
Went back today. They were nice but couldn’t tell me what was needed to prove this was a sale from an individual and not a broker or dealer. The “director” was out but will be back tomorrow. In the meantime, I sent them floridas dept of commerce showing they were not a boat dealer, their website showing the primary business is tours and rentals, and a couple of other pieces of information.

I have a bill of sale. Also lists the owner as xyz llc. Lists the prices of the boat, trailer, motor, separately. Signed by owner.

I think you’re going to need separated bills of sale notarized. One for trailer one for hull. DMV will want originals as will LDWF.

Now on to the state dept of revenue. Same song and dance as the local govt.
They claim bc he listed the boat under his LLC he must be a builder or dealer/broker. But also can’t tell me how to prove it otherwise. So now I’m being sent to a special dept in Baton Rouge to sort this out. They did accept my email chain from the local govt acknowledging the proof I provided was enough to say this was an occasional sale.

Final update:
The state office in new Orleans scanned and sent my information to the baton rouge office last Friday. Including my email chain with the local office. I thought I was in no man's land. Tues am first thing I got my approval letter from the state in my email. Off to the wlf office in br.
