correct me if I'm wrong but, once all the data from the wreckage is gathered wouldn't a group of engineers be able to reverse engineer it and make a determination as to what logically happened to produce the accident?

obviously hydrocarbons don't occur magically, they came from somewhere or formed in the well because the situation presented itself.

Am I being naive or does it sound like everybody trying to avoid criminal negligence in light of the 11 victims?

The BOP should be recoverable, but significant changes/activity has been going on to facilitate well shu-in that might compromise the findings of a forensic examination.

The Rig should be recoverable but was on fire for a number of days and has sunk to the bottom of the seafloor and would likely be there for a year or so untill recovered which might compromise the findings of a forensic examination.

The well and formation are below the mudline and can not be deconstructed which might compromise the findings of a forensic examination.

In my opinion, there will plenty for any lawyer to create resonable doubt in any criminal proceedings and the findings of any forensics will be disputed by the party that is cast in the most negative light.
