Do you even understand what they ruled on? They didn't rule at all on whether or not the moratorium was proper - that'll come later.

The ruling prevents the moratorium until that time.

What sort of impact did you expect from a stay hearing?

I was certain that Judge Dennis was going to be the "problem" in this case. I suspect that this will be the same panel that will consider the appeal.

I'm about halfway through listening to the arguments. He was much harder on the Respondents and beat them to death over administrative abilities.

Actually, it does. If an aggreived applicant believes the MMS is being dilatory in processing or granting permits, they can go to Feldman for the imposition of sanctions for violation of the injunction.

Dennis did not give a damn about what the actual burden was on the Department to obtain the stay (which was, as you pointed out, was all this hearing was for). His questions, and his arguable position, is more appropriate for the merits of the appeal.

I have an uncle who manages a division of a large O&G gas company in Louisiana and his opinion is that companies are not going to risk spending the capital on re mobilizing assets offshore just to be turned around when this moratorium is eventually pushed through.

I applaud the courts for fighting against big brother but the consensus is that Barack and CO will succeed. Sucks

If the King will be pissed off at you for drilling and the King does inspections of your facilities and can fine your butt at the drop of the hat for finding a piece of everyday paperwork with a typo on it do you think you are going to buck the system much.

I'm no lawyer but it seems to me that the Federal Govt could be sued if they lose on the Moratorium issue and/or dont grant any new permits.

It will be easy for many to show direct loss from this.

Why hasn't anyone in drilling in shallow water done this? From my understanding not one permit has been granted anywhere since the incident.

The moratorium affected only rigs deeper than 500 feet. So, the ruling doesn't affect shallow water rigs, and the MMS is able to issue those permits at its discretion.
