Canandaigua, N.Y. (WHAM) - Court documents released by the Ontario County Sheriff's Office spell out the moments that led up to the crash and subsequent DWI arrest of a New York State Assemblyman.
New allegations state Brian Kolb, who represents New York's 131st District, had a blood alcohol level twice the legal limit and that he told a witness that it was his wife who was driving.
That witness is a tow truck driver who received an emergency call from AAA to respond to a vehicle in the ditch off County Road 41 in Victor. Kolb himself placed the call to AAA, a call that eventually resulted in his own arrest.
The tow truck driver testified to deputies that Kolb stood up when he arrived, put his hands up and said, "My wife was driving!", then added "You know how women drive." The tow truck driver said he did not see anyone else in the SUV. Kolb added that his wife was up in the house.

The 67-year-old Kolb reportedly told deputies that he admitted to having 4-5 cocktails at the Erie Grill in Pittsford and drove from there to Victor, where he crashed his state-issued 2018 GMC Arcadia into a ditch near his home. The distance between the Erie Grill and the spot where Kolb crashed is a 15-mile drive.
Court paperwork said Kolb's BAC registered a 0.16 percent.
A special prosecutor was assigned to the case, and there was word that Kolb may be the subject of an ethics probe. Kolb is scheduled to be arraigned in Victor Town Court on Thursday, January 9 at 12:30 p.m.
Kolb, a Republican, has served as the New York State Assembly Minority Leader since 2009. He resigned his position as minority leader three days after the crash.
