If its a complex case fed court > state all day. The role of the magistrate cant be understated. When you have multiple defendants (multiple lawyers) there are always going to be issues with discovery, scheduling order deadlines, motions etc. A quick call to the magistrate for a conference and you get a decision.

Now contrast that with a state court judge whose only asset is a 23 or 24 year old kid right out of law school who doesnt know anything. No comparison.

As a retired risk mgt consultant, I am not that upset over plt attys doing what they do. Mr. William Shakespeare was writing bad things about them a long time ago. Nothing has really changed since his times. But I do laugh when I keep hearing "we represent the little people" and then know the large majority have call screeners who screen out callers based on how much their claims might be worth. I am more bothered by the whore doctors, however, as for the most part, they would enjoy successful careers outside of working for plt attys. When one of N.O.'s most successful plaintiff doctors, and that is a very very large list, is routinely performing 5 & 6 back surgeries on the same plaintiff, time & time & time again, his reports reading the same time & time & time again, that to me is where the corruption is at its worst. The plt atty makes a fortune as that type of medical treatment reflects large policies, the doctor makes a killing..think, conservatively, $25K a surgery...and the little guy may walk away with a settlement, minus any paid specials or courts costs & atty fees, but is left a cripple for life. For what initially was a soft tissue lower back injury.
