Once this goes to trial, a search warrant will be required.
You keep saying this, but it isn't true. Phone logs can be obtained through simple requests for production in civil cases, and already are. Once insurance companies decide they like this, waiving any right to privacy will be a condition of the policy.

How will they know if I'm just looking at Facebook or tinder or some shite? You can't time stamp that.

quote:Agreed. I learned my lesson. My car has auto braking sensors and I looked down to glance at an email. Going 45 mph, the car 75 yard in front of me suddenly slammed on his brakes because someone ran a stop sign on a side street in front of him. Had I not had the auto-braking technology, I would have rear-ended the car at a full 45 mph.
Definitely more dangerous than drunk driving. Never came close to wrecking while I was drunk. Several close calls while texting or looking at my phone

If you can't text and drive, you shouldn't be able to drive.
I love this idea.

Police are not governed by civil procedures and rulings. They are governed by Criminal procedures and rulings.
I would be extremely surprised if the courts don't see this as an invasion of privacy and force the issuance of a search warrant.

Just read about this on another article. Terrible idea and a great excuse to get into more smartphone without a warrant.

Or, you know, just check the phone text records at the time of the crash.
Duh.
Stupid government

I roll my window down and motion for them to do the same. Then I yell at them to put the phone down.
