Don't forget that my autopilot will be using a multitude of sensors in multiple wavelengths of light and probably acoustic sensors as well that will provide valuable data in the lawsuit/criminal case.
If you drive a newer car, it's already probably storing X minutes of sensor and input positioning data similar to an airplane's flight data recorder. If your car's sticker listed something like "telematics", it's got a black box that is constantly recording a number of minutes of data on things like throttle position, steering wheel position, velocity, acceleration, brake inputs, etc. that is subject to subpoena.
Autonomous vehicles will almost certainly take that storage of data up several notches, if only to provide data that can protect the automakers in the inevitable lawsuits.
