Has the D.A. charged him with manslaughter?
Just because the guy was arrested by the police doesn't mean that the D.A.'s office will take the case especially if they do not believe they can win.
I would expect the D.A. to hand this off to a grand jury and decide from there.

"Tough, I don't care" in regards to those criticizing his strategy decisions in this case.
EX: Gasser never asked for an attorney. They have 10 hours of non-custodial interview and 2 hours custodial interview. Had a consent search for his home. Lots of things they gained due to their strategy.
