Nope. OP said they got married 6 months after the house purchase. That early into the loan term, his monthly payment has about 2x as much going towards interest as it does to actually paying down the principal.

what you 2 kids need to do is put up $30,000 in a CD (to account for the divorce costs) or make a separate property agreement

that didn't include attorney fees, hers ran the tab up like crazy, assuring her that I'd be on the hook for it, mine was actually pretty reasonable

Assuming the facts presented by OP are accurate, the correct answer is that the house is his separate property. As others have pointed out, she may have a reimbursement claim if any community funds were used to maintain or improve the property. Those specific facts and issues would need to be sorted out in the legal process.

The wife's name is not on the mortgage. He's trying to determine if her name is legally on the title. The title has her married name on it but at the time of closing, they were not married.

No they wont, men are stupid, and will do the exact same thing that burned them the first time because, "its different this time, she really loves me, is nothing like my first wife, and would never do that to me." Have see it more times that I can count.
