And that's one of the big issues with stories like this. I have no idea what state on intoxication this guy was or wasn't in. But as things stand now, a guy and a girl can both get falling down drunk and decide to frick each other's brains out. But only one of them can decide it was rape when they sober up.

Well, they found his DNA on her, I'm guessing on her vagina. The question then is, what does that prove? Well, it proves he came into contact with her vagina. But does that prove he raped her?
He admitted he performed oral sex on her at some point that night. But he also said she consented to it and in fact it was her idea. Is there proof he is lying? Maybe. But if there is proof he's lying, the story doesn't say what it might be. Perhaps it's the other boy who was dropped off at some point. But the story does a poor job laying out the sequence of these events.

Perhaps she did perform oral sex on him and the DNA of his they found on her was on her face/mouth instead of her vagina.

I read the story from a few more news sites. Some clearly state that he performed on her. Snopes clearly states that she was giving him mouth-hugs.
The law and the stories were both unclear and left me wondering if my sensibilities had been assaulted.
ETA. The girls blood alcohol content was .341. She was in no condition to speak at all, much less ask to give or get oral.
