It also stated that state law creates a presumption "that no parent who has a history of perpetuating family violence shall be awarded sole or joint custody of the children."
Coutee's initial petition for divorce sought a joint custody arrangement, however.
A protection order had been filed by [husband's attorney] on Aug. 23, too. The order had been secured by Coutee against Giles. Three attempts to serve it were unsuccessful, according to court records.
...
There was no mention of abuse in the filed [divorce] documents until Coutee's request for a new trial. But he had made at least one report to the Rapides Parish Sheriff's Office before that.
Coutee filed a complaint on May 28, alleging that Giles had slapped him while "they were exchanging custody of their kids." The incident had happened on May 22, according to the report.
Coutee told the deputy he'd leaned into the car to give the kids a last hug before going to work when Giles slapped him on the left side of his face. Coutee produced a photo to show the deputy, who observed "redness on the left side of his jaw line below his left ear," it reads.
Coutee also showed the deputy a screen shot of a text that Giles allegedly sent to a mutual friend. According to the report, the text read that she'd "knocked the sh*t out of Thomas. It felt good tho."
Coutee told the deputy that the two had been arguing about Giles' boyfriend, who he claimed was addicted to drugs, and about Giles' desire to move.
He told the deputy he didn't want to file charges, but wanted the complaint on file.

a lot of states have a law where if there's a domestic violence claim and someone has evidence of a physical assault that an officer/deputy can confirm... then it doesn't matter if the victim wants to press charges or not, the alleged attacker is heading to jail for a day or 2
I guess Louisiana isn't 1 of those states

that's really the way all potential criminal charges are treated, it's 100% up to the DA as to whether the municipality wants to proceed or not

I don't disagree with you on this point
it's just that a lot of places give police no say in the matter... an arrest MUST be made on a DV case if the officer sees evidence of an assault... even if the victim expresses no interest in pressing charges
a business can express no desire to prosecute someone who's been busted shoplifting and that person will go straight home with just a "do not trespass" warning... this doesn't happen in DV cases

that's the way it's supposed to work, after OJ the word in LE agencies was that if a woman says a man looked at her cross-eyed, lock his arse up., but the DAs office has to at least know about potential charges, i.e., a lot of cops, if a man says "she hit me" or something to that affect, they were likely to respond with some thing like, "right, get out of here pussy" and it would end right there
