File a claim with your insurance company, give them the other party's insurance info and let them subrogate.

Why would the claimant be subject to a binding appraisal clause that they never agreed to? If it were the insured filing a claim, sure, but I don't see how that could be legally applied to a claimant where the insured is at fault.
