Your problem is that you are using logic. You are sitting in 2015 and looking back trying to use logic and make sense of everything.
Laws about alcohol and drugs were cobbled together as each situation arose.
Alcohol and drug laws were based on emotions at the time of enactment.
You can not make logical sense of emotional decisions made decades apart.
