You have missed the important part of your Bro Code scenario. In discussing it with your lush friend, YOU brought her up to gather information to pursue her. You made the first move in discussing her with him.

At 28, you should know you are too old to shout dibs so you did it by approaching him on a fact finding mission, your first move toward her. This gives you rights, not him.

Call the girl and ask her out. Surprise her with a nose ring appointment for Christmas. Get to steppin'.

I'm not nervous, because I've been rejected plenty of times also. Usually doesn't stop me. I'm just worried that I might've missed the opportunity when I didn't ask for her number the other night.

There's nothing poetic about a loser attitude. Give it a shot, unless you just don't want to have sex. Good topics to start with: being angry at your parents, the world being unfair, how expressing weakness is a strength.
