More states are going to the concept that if you are in an accident, no matter what your reading, then you are impaired and get arrested. This has been evolving for at least the last 10 years.

your friend wasn't "convicted" of a dui, he was charged with a dui.
he will possibly get convicted when he goes to court depending on a lot of factors. but with him being high, blowing a .094 on the scene, and swerving.. your boy will be in trouble. tell him to get a good lawyer.

He needs to lawyer up if he blew under the limit and the first test wasn't recorded.
To answer your question though, yes. My cousin was pulled over in Louisiana after drinking 2 beers while being underage. He blew well under the legal limit, but since he was under the legal age, he was charged with a DUI anyway.

Tell your dumbass friend to lawyer up, check into an intensive out patient program on his own accord, and grow the frick up.
