Well, there's no real proof of a crime other than Hank's murder, and they will never find that body. Money was laundered before they used it to buy the place.
Yes, they could take it, but I'm not sure a court would uphold the seizure.

i realized after watching a 2nd time that the phone call was to take all the blame off skyler and make it look like she was forced to go along. so caught up in the moment that i didnt notice the first time. awesome

Depends on if Marie gave them the tape off camera or not. If so, Walt is fricked. If not, then they still have no definitive proof that Walt cooked the meth because the only one who witnessed him do it was Jesse and he's not in the picture now. All they know without the tape and without the rat is what his family says. Hell they don't have the millions and even the money that Walt gave to Skylar for the car wash and for Hank's treatments, they still don't have definitive proof that it came from his meth business.
Speaking of which, does Skylar really think that the Feds are going to let her keep the car wash if they know she bought it with meth money? Come on now. And she should have gone with Walt because now she and Marie are going to wind up in witness protection. The police/Feds aren't just going to let them go stay at Marie's after Walt said "I've got more work to do".
Skylar, Marie, Jesse, the NNs, frick'em all. Pretty much the only characters outside of Walt that I don't hate are Todd, Holly, Badger, and Skinny Pete.
