The pipeline had one month to provide authorization for locating their pipeline on our property but failed to do so.
I located an attorney and expect to sigh the legal contract today.

I will let you know how it goes.

Do you know what year the pipeline was built? I understand the original RR easement was granted in 1947, which in those days the agreements probably allowed for them to grant an easement within their easement to other companies. Have you read the original Railroad Right of Way Agreement to see if that agreement allowed for them to grant easements for pipelines, electrical lines and so on...?

The pipeline was built in 1987 or 1988. I gave it a cursory look. As I recall the ROW agreement was for "servitude only" and would not permit them to legally provide for a pipeline ROW if they do not own the land beneath their tracks.
