I realize this was from November, but even today, the stock price for a cash offer implies it’s anything but a done deal.

A sure fire arbitrage opportunity like this doesn’t sit 26% off its buyout price without a decent amount of regulatory risk still to go.

Also, as I said back in July, and even more so now, if you’re confident in the deal, buy it in a tax advantaged account. No point in watching 20-30% or more of your profits go to Uncle Sam in a taxable account.

29%. Not saying TWTR didn’t have its issues closing but these large M&A deals are very often met with regulatory flack and often close. Not a guarantee of course, but the risk reward is interesting.

Stock is up 5% today after news yesterday that the UK CMA is no longer considering console competition concerns.

Outside of the FTC, which is looking like a clown with losses in court, every other regulator is only looking at the cloud gaming aspect at this point. Seems like a far smaller concern.

ETA: Trying to talk myself out of buying more shares. My wife says "we have the money." DANG YOU WOMAN!

It was announced in late ‘21 or early ‘22.. they’ve been trying to get over regulatory hurdles since.

Could be April, could be July. Could be never.

The risk of the deal not closing is why there’s been juice in ATVI price.

Sell options if you believe it will go through soon. Been printing money for a year now.

The CMA's final determination will be at the end of April, so I'll probably hold off a little so the stock settles a bit after today's news.

Seems very likely at this point that it will clear EU and CMA scrutiny though, which would leave the FTC on a hill all alone. Would be shocking for the FTC to be the only thing that halts the deal.

The purchase price is $95 a share. Was trading at $83 when I looked an hour ago.

I ended up buying 130 shares at $75 on 2/10. Don’t believe I’ll buy anymore at these prices since the upside is now more limited.

I think they have a solid chance of winning on appeal, and the fact that they're willing to appeal shows they're dedicated to seeing this deal go through.

If you’re buying Activision here you are halfway hoping the deal falls apart and you can just own the company with $3B more cash on hand.

I'm still pretty confident the deal closes.

You’re one of the few. No company has ever won their appeal against the CMA, the EU is still proving the merger, and the FTC in the US has already sued to block the deal.

I’m in on Activision and I’d like them to just go there separate ways, At this point

Apple just won an appeal last month, and the UK government can actually step in in this case. The government is trying to set the UK up as a tech hub. This sort of decision flies in the face of their publicly stated goals.

Yes, I read that as well. And the decision that went in Apple’s favor in March wasn’t an appellate victory over the CMA after it had made a decision against the company. No decision had been made by the CMA. The Competition Appeal Tribunal ruled that the CMA waited too late to open its investigation.

Unlike the Musk/Twitter deal, which would have cratered the stock had it not gone off, I don’t believe you fellows are going to be bag holders if this deal doesn’t go through. I mean they get $3 billion or so and will continue operating as they have for years. Few see this deal closing, and yet the market reaction had the stock closing up near session highs today.

The CMA is now negotiating with MS/ABK. The UK does not want this deal to "close over" their jurisdiction.
