You want the government (or its agents) to act outside of the law when they deem fit? So what is the purpose of law?

you don't know that this is done all day every day? cops determine whether to stop speeders or not. if they stop, they decide whether to ticket or not. if they see a joint, the cop can decide to arrest or not. if the cops arrest, the DA has the authority to determine what charges, if any, to prosecute on. When you get to court, the ADA usually has some discretion to amend the charge if you plead. In typical guilty plea, the conviction is for something less than the actual crime. even speeders plead to no drivers license on person.
justice has an element of mercy.
