So if it's not traced and therefore an "exact replica" does that play into it at all?
No. The intent behind the artwork is to look like the LSU trademarked eye. There will be some shops in BR that won't sell these for you because they aren't licensed. Brian Hommel will find you, trust me.

since this is an original painting and not a replica or copy of the eye, it can be sold as much as you want.. lsu will not give you any problems with this.

She's not talking about selling them around town stores. She just had a couple of friends offer to pay and we got to thinking, what if others wanted to have her paint them one (like some of those in this thread). Would she run into problems?
Sounding more and more like she won't run into any problems because it's a pretty unorganized situation (ie the wine glasses).

Correct.
As soon as those go into stores, or online though...I'd expect a letter. Since its such a small operation, you'd just get a letter asking you to stop or begin licensing the product. If these end up in a local LSU shop or the like, or online...Hommel will find you, trust me.

What schools?
I'm from North Carolina so mostly ACC schools, most of them are UNC, Wake, NC State, but she has done some LSU ones for herself

I'd love to own one of those, It's very well done. Lemme know(somehow) if one could be purchased. As far as you don't list them for sale on any entity i.e. website/ store. I doubt you would have any trouble from LSU. I will say keep it low key, many years ago, a teacher of mine had shirts with the LSU Logo made for a field trip, and someone inquired as to the validity of them. But they were direct copies of the trademarked logo, this type of a variation you should be able to get away with barring people like me who would gladly pay for a copy.

Ok, thanks guys!
So the worst that would happen would be a letter asking her to stop? It's not like she's really trying to make a bunch of money. She just has fun painting and people like that one that she did of the Tiger eye and so it's sort of happened like that. She's certainly not going to be pimping it out to stores or anything.
Is that about right? Sounds like she should be in pretty good shape it seems.
I appreciate the help and insight of the rant (useful for once).

I think you should be fine, just keep it low key between friends... maybe even delete this thread. lol It is really the commercial aspect that is troublesome. I'd still love to have one though.

I got popped with a cease and desist for posting photos online...it will only be a matter of days before you have a certified letter from Collegiate Licensing if you pursue any commercial endeavor.
The CL process is a serious hassle if you pursue it... a one year contingency agreement, you need a $1mil liability policy, minimum sales, approval of everything you sell, etc.

Just give it a shot. They would probably have to send you a cease and desist before taking any legal action. Best bet is not to advertise through multimedia but rather word of mouth. And if you claimed that you were charging for the materials, you could get away with it anyway.
