Oh, I get that. It's just stupid to think that is somehow a legal defense. Now, if several witnesses step forward to state that they heard these derogatory statements, then the charges are more likely to be dropped by victim. Not because it's a defense, but because the "victim" will now carry the label of a raging racist. The media will report his comments and his reputation will be ruined. Should give the victim something to think about.

I understand what you're saying and what you're not saying. You're not comparing rape with this assault but rather comparing the assumed innocence of a victim in any case.

That said, never use the word rape. It tends to set off the overly sensitive among us.
