You are probably right.
As an officer of the court, Hillar has a duty to protect the system and to avoid the appearance of impropriety.

The DA has a duty to maintain public faith in the judicial process.

Even if a nolle pros is a proper option, there are public policy reasons to take the matter to a grand jury.

This will play out in the judicial system where witnesses are weighed and not counted. We will have to wait and see the results- fair or not. I certainly do not know what happened at Shady's. It's a mess for both JJs, the others involved and LSU. Sad that it also seems to divide part of the Tiger Nation.

No one "wins" regardless of result.

This case has been badly mishandled from the beginning. The BR Police Dept should be ashamed of itself. JJ was arrested for a felony based on the statements of two witnesses who have severe credibility problems. Any experienced attorney knows that the DA could not win this case. I am sure Unglesby has the goods on the "victim". This reminds me a little of the Strauss Kahn rape case up here. But here the DA did the right thing and dismissed the case. The DA in Baton Rouge has no business presenting this to a Grand Jury if he knows its bullshite. And since when is battery investigated like this and presented to a grand jury. 99.9% of all battery charges are filed via bills of information. Grand juries are reserved for the big stuff. When all of this is dropped the personnel at the BR police dept responsible for this debacle should be severely disciplined. This relatively minor incident became a national story mostly because the police got big heads. DNA tests for a battery case....what a joke...

Do we really know that this was the only basis for the arrest?

I don't know what happened that night, who did or didn't do what, and would rather not assume anything and let this process play itself out.

While I think the entire situation got overblown, I can't imagine BRPD making as big a spectacle as they did, if there was potential for them to look like asshats on the back end. Could they be this stupid?

That is the problem. If they could prove he kicked someone in the face, they wouldn't have gone to GJ.

His admitting giving false statements to police are definitely relevant and I can't see a judge throwing them out as inadmissible.

However, I'm not sure why this is still being discussed on this board. We have some fans who are hoping beyond hope that Jefferson is never heard from again. They will not let it go.

We're talking about BRPD here. Maybe they used this to distract from another cover-up they were actively working. I trust BRPD about as much as I trust the CIA, honestly.

Deal with Cops often?

They main issue is that they arrested Jefferson and Johns on the probable cause they had the morning of the fight.

They spent a week conducting an investigation in front the media only to issue arrest warrants based on the initial report that was drafted seven days prior.

And, in those seven days, they failed to properly investigate the case choosing to conduct DNA test for battery case instead of interviewing potential witnesses.

I have never been impressed by the intelligence (or lack thereof) of the BR police. You better believe they can be this stupid. They are people like anyone else and can easily lose their heads as they get caught up in things. Believe me, they are going to come out of this looking real real bad.
