Mine was hacked a few months back for 10k points and a racing game. My original 360 was stolen from my house a couple of years ago so my issue is a bit different than yours (I'm thinking/hoping the hacker has my 360 so I can get it back). My account is still blocked while they investigate it but they were very quick to offer to refund the payment (I had already called the bank). Hoping they get it all sorted out soon so I can finally redeem my Catwoman code for Arkham City (got another 360).

Happened to me about a month ago. Xbox renewed my year subscription because the card on my account was used to renew the subscription every year. Also, I got the money back from my bank, and Xbox let me keep the 9k microsoft points that went unspent.
As far as the 2-3 months, they told me the same thing. You're looking at 7-10 days max.

my gamertag got hacked once and yeah they froze my account for nearly a month until i got it back..
they tried to charge all kinds of stuff to my credit card, but it was one of those wal mart cards with no balance on it. haha.
