It was the judge who saved him money. This is what the prosecution wanted...

He can thank the Lord for the Judge who presided over his case. I am SURE the Judge was philosophically aligned with him and use his power to lessen the blow. I am also sure their are career Blue Suits in DOD that are fuming, wanting the LtCol hung from a yardarm.
