The border is composed of federal property and private landowners IIRC. On one side for the state to build on Fed property would be illegal and eminent domain by private land owners does not apply in Texas.

Mobilize is the guard and unilaterally build temporary barriers where needed.
Then dare the federal government to do something about it.
