Yeah that's a tough spot for the cop. The kid may be dropping the gun but he's also raising his hands at the same time (potentially to shoot). The cop can't assume he's about to drop the gun.

At that moment, the kid should have tossed the gun away from himself while telling the cop that's what he's doing.

Kid shouldn't have been running in the first place. He isn't even the one who did the shooting (his friend did). Kid picked up the gun and began running.

If the call wasn’t for an actual shooter and the suspect wasn’t running and actually didn't have a gun it would be different.

Zero way for that cop to know he tossed it behind fence.

Did the 21 year old that was arrested also have a gun? I ask because it seems possible that he told the kid something along the lines of, "here take this a get rid of it."
