That's not true. The statute only requires that the mail- in- ballot be marked and mailed by 8:00 p.m. on election day.

The fact that the state had previously required that the mail in ballots be received by election date at 8:00 does not demonstrate that the statute required that, which it did not.

All of these tweaks in at least 8 states should never have occurred in the first place as there are only supposed to be two ways to change election rules; State Legislatures and/or Congress.

there is debate as to the whole episode. as i understand it, a change such as the mail in's was supposed to be put up to the state for a vote. that never happened thus calling into question the legality of the mail in's. the state legislature supposedly has the option to allow election officials to make decisions such as the mail in policy and that is why the legislators were being told they could "take their power back" which would invalidate the mail in's.
