It’s statutory, not constitutional. It’s called the Posse Comitatus Act.

It does not apply to the National Guard. Technically it doesn’t apply to the Navy or the Corps either.

Bottom line: You can use the National Guard.

The question is not whether you can use the National Guard is the manner in which they are being used same for the Coast Guard.

Oh and did anyone happen to notice at what time Biden was sworn in?

There are active duty troops there as well. This is a matter of public record.
