Both of them are based on what people identify as, so what's to stop anyone from just saying "yeah, I'm white, but I identify as black?"

As others have said it's likely unconstitutional and also unenforcable...how do they prove in court that a white person who says they identify as black is lying or doesn't really identify as such? Same thing for a gay person...do they have to suck a dick in court to prove it?
