This 100%, all they have is a bunch of he said she said! if they could corroborate any of it they would already issued LSU a NOA. Sending it to the independent counsel protects them both ways. If they find something ok we got them, if the don't hey we tried.
Also probably protects them legally if the independent investigation says there is enough evidence. But it all turns out to be bogus LSU couldn't sue the NCAA, because the recommendation came from an independent investigation.
