Agree 100%. What my employees do on their own time is none of my business. The problem here... is that the law has been abused so much it's no longer protecting anyone and damaging employers. You essentially have superset of employees that are almost untouchable even if incompetent.

The abuse never seems to be part of the consideration in these kinds of court cases.

If you have a gay or trans troubled/non-performing employee it will make it more difficult to fire them. In practice as the supervisor you will just have to document the troubles and non-performances with documented warnings more than the average employee. But with paperwork in place it should be no issue to fire a bad gay or trans employee.
