So one man had a taser that wasn't turned on and didn't pose a threat. The other guy *fired* a taser at an officer. There's the difference you're ignoring.
Besides, policing isn't based on precedent like legal rulings. Police make decisions in seconds, not weeks to months.

It’s illegal to use a taser to commit a crime, ie, shooting it at police. The legal definition of a deadly weapon: anything that’s capable of causing death or serious injury. Tasers are less-lethal weapons, HOWEVER, they can cause injury or even death in some cases.#justified
