Obviously you are 100% correct...but I made the point about the police because that seems to be the gist of their issue and the quote I added was about being able to function without police.

True and a damned shame no doubt. The city and the state taxpayers are liable for the damages because it is those individuals who allow the sad state of police departments to exist in the first place....we ask police to do a near impossible job for a meager salary and then provide them with minimal support. Those property owners were as satisfied with the status quo on that front as most of us are....but we shouldn't be...we should realize the police or as important as health care for the survival of the individual.

The State is not liable unless the State provided a statutory path for a liability to occur, if these were State actors, possibly a "taking suit" via Constitution or codified from "taking", but in this case they are third parties.

Motion to Dismiss for failure to state a claim in which relief can be granted comes to mind. <-----
